Serving as General Counsel for ESS since 2014, Todd Higey is the company’s chief legal officer, overseeing a broad range of matters relating to the operation of the company’s business, including monitoring, analyzing and implementation of the company’s compliance with applicable federal and state regulations. Previously, Todd was in private practice litigating a variety of employment-related cases organizations ranging from small businesses to Fortune 500 companies, as well as advised on contract formation, human resources policies, and general risk management.

A noted subject matter expert on consumer reporting and employment law, Todd actively contributes to the industry, participating in educational speaking engagements and authoring various articles. He also chairs the PACER Task Force and serves on the Board of Directors for the Professional Background Screening Association (PBSA) and served as co-chair of the Legal & Legislative Affairs Committee Birmingham Society for Human Resources Management (SHRM) chapter.

Todd holds a Bachelor of Arts degrees in Philosophy and English Literature from Toccoa Falls University, and a Juris Doctorate from Duquesne University.

A drug and health services professional for over 30 years, Scott Kitchens joined Employment Screening Services in 2014. As Vice President of Drug & Health Services, Scott and his team assist employers with the management of their DOT Compliance, drug testing, physicals, Tuberculosis (TB) testing, and various other health services. Scott draws from his vast experience including laboratory administration, third-party administration and his ownership of an onsite drug testing company to provide ESS drug and health services clients with the highest quality service and expertise. Scott ensures ESS maintains strict compliance with the National Accredited for Administration of Drug and Alcohol Testing Programs (NAADATP) Certification, a program facilitated by the Drug and Alcohol Testing Industry Association (DATIA).
